How much is a Wheeling crash claim worth if two companies share fault?

Everyone says wait for one insurance company to name a number, but actually your claim is not worth much until fault is pinned down fast.

In the next 24 hours: get the crash report number and identify every possible payer. In Wheeling, that may mean the Wheeling Police Department, Ohio County Sheriff, or West Virginia State Police if it happened on I-70, Route 2, or a rural highway. If harvest traffic was involved, do not assume the driver is the only target. A grain truck company, farm employer, loading company, maintenance contractor, or parts maker may all point fingers at each other.

Save photos of vehicle logos, trailer numbers, DOT numbers, skid marks, fog conditions, and road layout. Ohio River valley fog matters. So do overloaded trucks and slow farm equipment on public roads.

If you are undocumented, filing a bodily injury claim does not put you into an immigration process by itself. The insurers want proof of injury, wages, and fault.

In the next week: build the money side. Ask for itemized bills, missed-work proof, and the police report. If one insurer says "we only cover the tractor" and another says "we only cover the trailer," keep both claim numbers. In West Virginia, fault is divided by percentage. If you are found more than 50% at fault, you recover nothing. If you are 50% or less, your recovery is reduced by your share.

That means a $60,000 case can turn into $42,000 if you are assigned 30% fault.

In the next month: expect lien and subrogation issues. If your treatment was paid by health insurance, Medicaid, or workers' comp, they may demand repayment from any settlement. If you were working when the crash happened, a private West Virginia workers' comp carrier may be involved too.

A rough Wheeling value is usually:

  • Medical bills + lost wages + pain/suffering, then reduced by your fault percentage and any repayment claims

Also remember West Virginia's usual lawsuit deadline for injury is 2 years.
